01 About these terms
These Terms of Service ("Terms") govern your use of the website at www.kuracafe.in and your visit to the Kura café in Indiranagar, Bangalore.
By using the website or visiting the café, you agree to be bound by these Terms. If you do not agree, please do not use the website or visit the café.
These Terms form an electronic contract under the Information Technology Act, 2000 and the Indian Contract Act, 1872. They are read together with our Privacy Policy.
02 Who we are
Kura is a specialty coffee café in Indiranagar, Bangalore. The website and the café are operated by Gem Cap Synergy ("Kura," "we," "us," or "our"). You can reach us at kiran@gemcapsynergy.com.
03 Using our website
You may use the website for personal, non-commercial purposes — to read about Kura, to apply for a role with us, or to contact us. When you use the website, you agree to:
- Not attempt to gain unauthorised access to any part of the website, any server, or any data not intended for you.
- Not introduce viruses, trojans, worms, or any other harmful material.
- Not use any automated means — bots, scrapers, harvesters — to extract data without our written permission.
- Not impersonate another person or submit false information through any form.
- Not use the website in any way that violates any applicable Indian or international law.
We reserve the right to suspend access to the website at any time, with or without notice, for maintenance, security, or legal reasons.
04 Visiting our café
Right of admission
The right of admission to the café is reserved. We may refuse entry or service to any person who, in our reasonable judgement, is intoxicated, behaving in a manner that disturbs other guests, or otherwise violating these Terms or applicable law.
Conduct in the café
When you visit, you agree to be respectful of our staff, our other guests, and our property. We follow all FSSAI hygiene standards, fire safety requirements, and other applicable rules under the Food Safety and Standards Act, 2006 and the Karnataka Shops and Commercial Establishments Act, 1961.
Photography
You are welcome to photograph your food, your friends, and the room. We ask that you do not photograph other guests without their consent, and that you do not photograph our staff areas, prep areas, or back-of-house operations.
Allergies and dietary information
Please tell our team about any food allergy or intolerance before ordering. While we take care to inform you about ingredients on request, our kitchen handles wheat, dairy, eggs, soy, peanuts, tree nuts, sesame, fish, and shellfish, and cross-contact cannot be entirely eliminated. You order at your own risk if you have a severe allergy.
Children and pets
Well-behaved children are welcome. Service animals are welcome. Other pets are not permitted inside the café for FSSAI hygiene reasons.
05 Orders, prices & GST
All prices on our menu are in Indian Rupees and are inclusive of Goods and Services Tax (GST) unless stated otherwise. A service charge, if applied, is shown separately on your bill and is optional — you may have it removed at your request, in accordance with the guidelines issued by the Department of Consumer Affairs.
We reserve the right to change menu items and prices without notice. Seasonal items may run out before the end of the day, in which case we will offer the closest available alternative.
06 Reservations & cancellations
Reservations, when offered, may be made by phone, email, or through any reservation platform we use. By making a reservation, you agree to:
- Arrive within fifteen minutes of the booked time, after which the table may be released.
- Update or cancel the reservation, where possible, at least two hours before the booked time.
- Pay any deposit, prepayment, or cancellation fee we have communicated to you at the time of booking. Where required, such fees will be made clear in advance.
For larger groups (six or more), we may require a confirmed reservation, a pre-set menu, and a deposit. We will tell you in advance if so.
07 Payments & refunds
We accept payment by card (Visa, Mastercard, Amex), UPI, and cash. Payment is due at the time of service.
Refunds
In accordance with the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020:
- If a dish is materially not as described or is served in unsafe condition, we will replace it or refund it.
- Cancellations of confirmed reservations follow the policy communicated to you at booking.
- Refunds, when due, will be processed within seven business days through the original mode of payment.
Gift cards and vouchers
Any gift card or voucher is subject to the specific terms printed on it or communicated at the time of issue, including validity period and redemption rules.
08 Job applications
If you apply for a role through the website, you confirm that:
- The information you provide is true and accurate to the best of your knowledge.
- You are at least eighteen years old, in accordance with the Child Labour (Prohibition and Regulation) Act and applicable hospitality industry rules.
- You consent to us using your data to evaluate your application, in line with our Privacy Policy.
Submission of an application does not create any contract of employment. Any offer of employment, if made, will be in a separate written letter setting out the terms.
09 Intellectual property
The Kura name, the kura wordmark, the brand colours, the photography on the website, the menu, the website code, and all original content are owned by Gem Cap Synergy and are protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable Indian intellectual property laws.
You may not reproduce, distribute, or create derivative works from any of our intellectual property without our prior written permission. Personal, non-commercial sharing on social media (for example, photographing a dish and tagging us) is welcome.
10 User-generated content
If you tag us in social media or send us a photograph, message, or feedback, you grant Kura a non-exclusive, worldwide, royalty-free, perpetual licence to use that content on our own social media, in our marketing materials, and on the website — with credit to your handle where reasonably possible. You can ask us to take down any such content by writing to kiran@gemcapsynergy.com and we will remove it within a reasonable period.
You confirm that any content you share with us is your own, does not infringe anyone else's rights, and does not contain any material that is unlawful, defamatory, obscene, or threatening.
11 Third-party services
The website links to third-party services — including Google Maps, Instagram, our payment gateway, and others. We are not responsible for the content, accuracy, or practices of those third parties. Their terms and privacy policies apply when you use them.
12 Limitation of liability
To the maximum extent permitted by Indian law:
- The website is provided "as is" and "as available," without any warranty of any kind, express or implied.
- We are not liable for any indirect, consequential, special, or incidental loss arising out of your use of the website or your visit to the café — including loss of profits, loss of business, or loss of data.
- Our total liability for any claim arising out of these Terms is limited to the amount you paid us in the twelve months preceding the claim, or ₹10,000, whichever is greater.
Nothing in these Terms excludes or limits any liability that cannot be lawfully excluded or limited under Indian law, including liability for death or personal injury caused by our negligence, or any liability under the Consumer Protection Act, 2019.
13 Force majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control — including acts of god, natural disasters, fire, flood, epidemic, pandemic, government order, civil disturbance, strike, lockout, power failure, internet failure, or any other force majeure event.
14 Governing law & jurisdiction
These Terms are governed by the laws of India. The courts at Bengaluru, Karnataka, India have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or your use of the website or the café.
We ask that you first raise any dispute with our Grievance Officer (see section 16). Most issues can be resolved quickly with a direct conversation.
15 Changes to these terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent change. For material changes, we will draw your attention to them on the website. Continued use of the website or the café after a change means you accept the updated Terms.
